**RENTAL AGREEMENT **
**1) RESERVATION DEPOSIT**
A 50% deposit must be received upon the time of reservation, the remaining balance needs to be paid 60 days prior to their arrival. If the reservation is booked within 60 days prior to check-in, payment should be made in full.
**2) CANCELLATION POLICY & FEE**
The cancellation policy is mentioned in the booking. Holiday dates are excluded from this cancellation policy. All holiday dates are non-refundable. Holiday dates are as follows: Christmas and New Year’s weeks, Thanksgiving week, Semana Santa week, BPM and Ocazo Festivals.
**3) MODIFICATION FEE**
If a change of dates is requested more than 60 days before check-in, it is possible upon availability and rates adjustment, and subject to a 10% rebooking fee.
**4) CREDIT CARD AUTHORIZATION FORM & SECURITY DEPOSIT**
The following credit card authorization form must be completed and approved in this rental agreement. This authorization allows Villas Luxury Tamarindo to place a hold on the credit card. Guests need to provide a credit card even if they have used an alternative method to pay. This deposit will be released 7 days after check-out to the same credit card, provided nothing is missing, broken, or terms of this contract violated. The apartment must be kept in the same condition at check-out as it was when Guests arrived. If something does get broken, turns up missing, or terms of this contract are violated, the value of these items or the penalty amount will be charged to the card. If Guests do not have a credit card on file, they will be required to provide one before check-in by calling the office at any of the listed numbers. Please note all reservations with stays during BPM or Ocaso Music Festivals require an extra refundable security deposit. Guests authorize Villas Luxury Tamarindo to place a hold to cover any incidental charges related to their stay at this property. A hold will not be made on their credit card if a Security Deposit was charged 30 days prior to their arrival. As per our payment policy, 50% of the Total Room Rate will be processed first, then the other 50% with fees, 60 days prior to arrival. Guests agree to pay for this purchase and indemnify Villas Luxury Tamarindo against any liability pursuant to this authorization. Guests understand that their signature on this form will serve as an authorized signature on the credit card charge slip. All credit card transactions are processed through PAYOO. Since all of our transactions are processed remotely, and for their own protection, verification of the credit card holder is required. For all credit card transactions (credit card payment, security deposit, damage voucher) it is required to provide a photo of:
1) the credit card used in the transaction
2) a valid form of identification document of the credit card holder (Examples: Driver’s license, passport).
**5) LATE PAYMENT POLICY**
In signing this contract, Guests agree to make all payments by the scheduled dates listed in the Deposit/Payment Schedule above. If any payment is not received by these scheduled dates, Villas Luxury Tamarindo will charge a 1% fee per day on the outstanding balance. In the event that a scheduled payment is not completed by the due date, Villas Luxury Tamarindo reserves the right to cancel the reservation and Guests forfeit any payments made.
**6) CHECK-IN, CHECK-OUT**
Check-in time and Check-out time are defined on the website. If Guests would like to request a late check-out, they have to confirm in writing with Villas Luxury Tamarindo staff ahead of time to ensure we don’t have any one-day turnovers. If we do not have a same-day turnover, we are more than happy to extend a late check-out. However, if we do and Guests do not leave on time, they are compromising the check-in of other guests. Any late check-out without written permission from our staff will be charged $50/hour. Unauthorized early check-ins will also be billed $50/hour. Please confirm in writing with our staff beforehand if Guests would like to check-in early. Guests with any outstanding balances overdue and/or without this rental contract approved will not be allowed to check-in.
**7) OCCUPANTS/ VISITORS**
Outside visitors not pre-approved with Villas Luxury Tamarindo are not allowed at any time inside the premises unless authorized with written permission by Villas Luxury Tamarindo staff. In order to receive written permission, Guests must send an email a minimum of 24hrs ahead of time with visitors’ full name. Exceeding the number of guests indicated in this contract is grounds for eviction and a $300.00 USD penalty charged to the card on file. In particular, prostitutes are not allowed. Their relationship with criminal elements makes them a risk to our homes. Under no circumstances are they allowed. In case Guests don’t have the detailed list of guests now, they have to advise Villas Luxury Tamarindo Staff at least 3 days before the Check-in date.
**8) SMOKING**
The Property is a strictly non-smoking rental. We ask that Guests not smoke in the apartment at all. If evidence of smoking, such as the smell of cigarettes inside the home and/or cigarette burns on the furniture, is noticed by the cleaning crew, there will be a $300 damage assessment. Smoking is only allowed outside.
**9) SLEEPING CAPACITY & DISTURBANCES**
Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:
A) Occupancy exceeding the rental capacity stated in this contract.
B) Using the premises for any illegal activities.
C) Causing damage to the premises rented or to any of the neighboring properties.
D) Occupancy and use of the premises and common areas in such a fashion that disturbs or offends other guests or residents.
E) Smoking inside the house or condo. Smoking is only allowed outside.
F) Any other acts which interfere with a neighbors’ right to quiet enjoyment of their property. We wish Guests to have an enjoyable vacation, but Guests must respect the rights of other guests.
**10) PETS**
Pets are strictly not allowed unless otherwise discussed in writing with Villas Luxury Tamarindo. Violation of our pet policy is grounds for immediate termination of the rental agreement, eviction with no refund, and/or a $300.00 USD penalty charged to the card on file.
**11) PERSONAL BELONGINGS**
We ask that occupants take full responsibility for securing their personal belongings. Please lock valuables whenever leaving the apartment. Villas Luxury Tamarindo is not responsible for any lost or damaged personal items.
**12) THEFT PREVENTION**
As in many places around the world, petty theft and burglary can be common; it is almost always an act of opportunity. We are asking Guests to help us in avoiding circumstances that would result in any loss to them. For instance, we provide safes; please use them where they are available, make sure to lock the door at night when Guests go to sleep, and also don’t keep the key in the door while hanging around the apartment. Cell phones, laptops, and cash are the most common targets. We ask Guests not to bring anything of tremendous value on their vacation. Please consider checking with their homeowner’s insurance, renter’s insurance, or if necessary, get a personal policy before traveling to Costa Rica, so anything that Guests bring that could become stolen would be covered, as we cannot provide any insurance for Guests. Guests acknowledge that they have read and understood the above recommendation in its entirety and agree to abide by them.
**13) AC/ ELECTRICITY/ WATER**
Villas Luxury Tamarindo is an ecologically minded business. We ask that Guests obey the following guidelines in regard to conserving energy: When using the air-conditioning units, we ask Guests to try to keep usage to a comfortable minimum. ACs must be turned off when Guests leave the property. If the air conditioning is left on while Guests are out of the property, we reserve the right to have someone on our team enter the property to turn it off. Guests will be charged a $50 fine for each time Villas Luxury Tamarindo finds the AC is left on with no one home. Also, we ask Guests to turn off all lights when they leave any room. During the dry season, the Guanacaste province can suffer from droughts and as a consequence a shortage of water to the homes. If Guests are staying with us during the dry season, please try to use water conscientiously to avoid running out of water.
**14) NOISE LEVELS**
We are in a residential community and, although this is a holiday destination, it’s home to many people. As such, we ask that Guests respect their privacy and their right to a peaceful existence. Guests who create excessively high noise levels may be expelled from the property with no refund, and/or a penalty of $500 USD per incidence, charged to the card or security deposit on file.
– Between 8:00am to 6:00pm noise intensity cannot be greater than 80 decibels.
– Between 6:00 p.m. to 10:00 p.m. noise intensity may not be greater than 60 decibels.
– Between 10:00pm to 8:00am of the following day, excessive noise; above 25 decibels, either from music or people is strictly prohibited.
If Guests do not want to be constrained by this policy, we ask them please, not to rent this home.
**15) APPLIANCE MALFUNCTIONS**
There are no rebates or refunds issued for any malfunctions or service requests for air conditioning, televisions, hot tubs, pools, appliances, elevators, etc. as every good faith effort is made to ensure the property is maintained to the highest standards. Every effort will be made to effect repairs as quickly as possible. Additionally, there are no refunds for blackouts, water shortage, flooding, or construction at adjacent properties.
**16) CARE OF PROPERTY**
Guests are expected to care for the property as if it were their own. In addition, Guests acknowledge that unless Villas Luxury Tamarindo is notified within 24 hours of check-in of any damage or cleaning concerns, then thereafter, all damages or concerns to the property during their stay will be their responsibility. Wear and tear on a home is part of the normal use, however, one of the most common losses we experience, we consider a guest’s responsibility. The beach/pool towels that Guests may carry with them on their excursions are their responsibility to return to the house/condo. Guests will be held responsible for any missing towels and charges will apply. Each property will be inspected and cleaned after their departure. If the property is left in an abnormally dirty condition, a $200 fee will be charged to the credit card on file. If Guests request cleaning after they arrive, we will require at least 24-hour notice to set up maid service if not already included.
**17) EVENT FEE**
If Guests have been permitted to host an event at the property, whether it is formal or informal, there is a minimum event fee (unless otherwise stated on the invoice) and a refundable event security deposit.
**18) TENANTS LIABILITY**
Guests agree to accept liability for any damages caused to the property (other than normal wear and tear) by Guests or their guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. We are happy to attend to guests’ needs and to fix any issues reported about our properties. However, if it is something that happens to be the guests’ error, our policy is that we will charge the guest for the call. For instance, if the air conditioning control is set on fan and we get a report that the air conditioning is not functioning, or if the propane valve is closed and we get a report that the stoves/grills are not working.
**19) HOME KEYS / DOOR AND/OR GATE CODES**
Due to past security issues, we have implemented a strict policy regarding the sharing of keys or codes of our properties. Guests agree by signing this contract to never share their apartment and/or gate code or give keys of their vacation rental to anyone outside of their guest list. If Guests do so, they will be fined for breaking this clause. The fine will be assessed by the guest manager as each property has different logistics. For example, if Guests rent a golf cart, they are not permitted to share the gate code with the golf cart company.
**20) HOLD HARMLESS**
Accepting this rental indicates that Renter and its guests agree to HOLD HARMLESS & RELEASE the Owner, Property Manager, and all affiliated agents of the Property of any liability for any accident, injury, death, and/or loss or damage of personal property while at or renting the property. We do not accept liability for any inconvenience arising from any temporary defects or stoppage in the supply of water, gas, electricity, or plumbing. Nor do we accept liability for any loss or damage caused by weather conditions, natural disasters, theft, or other reasons beyond our control. Any services contracted for or by the guest are at the sole discretion of the guest. Luxury Villas Tamarindo, not the owner, is responsible for 3rd party services.
**21) ACKNOWLEDGEMENT**
Guests acknowledge that they have reviewed and understand the terms of this lease and agree to be bound thereby. Guests hereby apply to lease the above-described premises for the term and upon the conditions set forth. By signing below, Guests agree to abide by all rules and regulations pertaining to the rental property and will take responsibility for other occupants of the rental unit. Further, Guests authorize Villas Luxury Tamarindo to charge the credit card or check on file to cover any damage or loss caused by them or their guests during their stay. The Agent agrees to provide the Tenant with an itemized bill for all damages.
